Haulage firms relying on a spouse to take on a transport manager’s responsibilities must not see it as an excuse to cut costs and use someone with little industry knowledge, solicitors warn.
Small transport firms often rely on a family member to handle paperwork and accounts and sometimes this person assumes the de facto role of transport manager, despite having little experience of working in haulage. Often a spouse will hold the Certificate of Professional Competence (CPC) for Transport Managers qualification and have their name on the Operator’s Licence.
But both solicitors and traffic commissioners (TCs) say that even holding a transport manager qualification is not enough to show that they are exercising continuous and effective management.
