An inquiry into a fatal incident involving a lorry driver said delaying the journey during a storm could have avoided his death.
Bogdan Popa died when his lorry overturned on the M74 in Lanarkshire on 29 January 2022 during Storm Malik, where the Met Office had issued a Yellow Warning against strong winds.
Sheriff Adrian Cottam at Lanark Sheriff Court said the accident ‘took place during a period of time covered by a yellow weather warning’, and that the company, XDP Limited, ‘could have provided clearer information to drivers on the impact of stopping or postponing a journey due to high winds’.
Bogdan Popa had driven an articulated curtainsided lorry from Skelmersdale in west Lancashire towards Cleland, near Motherwell, to deliver flatpack furniture when his vehicle was hit by a gust of wind of up to 49mph, causing it to overturn and collide with another vehicle.
